TERMS AND CONDITIONS OF TRADE (CONSUMERS)
These terms and conditions will apply to all orders placed with Peter Child
save only as varied in writing by Peter Child.
Your rights as a consumer are not affected by these terms and conditions.
Prices and manufacturers specifications subject to change without notice. Prices
may change because of currency fluctuations or a change in the rate of VAT for
example.
Peter Child will only be bound once it has accepted an order by email, telephone
or in writing.
Peter Child will not be obliged to despatch any goods for which an order has
been accepted until it has received full payment by cleared funds.
Peter Child shall in no circumstances be liable to the Purchaser for any losses,
damages or charges incurred by the Purchaser due to the late delivery of the
Goods.
Goods delivered to the Purchaser shall be inspected by the Purchaser immediately
upon delivery and in all cases the Purchaser shall inform Peter Child, within
seven days of delivery, of any damage or shortages.
All goods are offered subject to availability and exclusive of carriage. We
may cancel any order at our discretion. You the customer may cancel your order
before despatch without giving a reason.
Cooling off period
In accordance with The Consumer
Protection (Distance Selling) Regulations 2000, you have seven days to change
your mind and cancel the order. Certain conditions apply as follows.
- The cancellation period ends on the expiry of the period of seven working
days beginning with the day after the day on which you receive the goods.
- You must notify us of your cancellation decision by email (or in writing)
within this cancellation period
- You should return the goods at your expense in an undamaged and re-saleable
condition for a refund
- We will make a reasonable charge for damaged, missing or defaced inner packaging
or for restoring goods to a saleable condition
- If the order is a business transaction these rights do not apply
The intention of the regulations is to allow you to examine the goods opon receipt
(and maybe reject them) in the same way as you would be able to examine them when
buying them in our shop. You do not have the right to try them out in the workshop
or use, say, part of a tin of polish before rejecting it. If the product is defective
then of course other rights apply such as the sale of goods act which remains
in force.
Purchasers cannot cancel an agreement or return goods for:
- goods made to their personal specifications
- goods which by reason of their nature cannot be returned or are liable to
deteriorate rapidly.
Peter Child will not accept any claims in respect of damage arising after
delivery or in the course of installation.
Faulty goods can be returned with the prior agreement of Peter Child.
Following the examination of the goods Peter Child may at its discretion repair
the goods, replace the goods or refund the sale price. Peter Child may also
at its discretion refund a reasonable cost of carriage incurred for the return
of the goods.
If a returned item is found to be in perfect working order the customer will
be charged the full cost price of returning the item to the customer.
Any warranty will be void and no claim will be entertained or liability accepted
for any of the goods arising from improper use, or damage caused by unauthorised
modifications or attempted repairs.
Peter Child shall under no circumstances whatever be liable for any indirect
or consequential loss howsoever caused.
In any event the liability of Peter Child in respect of any claim shall be limited
to the sale price of the goods.
Peter Childs policy is one of continuous improvement and Peter Child reserves
the right to make reasonable changes to product specifications at its discretion.
Products offered may be the subject of patents or other legal protection. Peter
Child accepts no liability for infringement of any such rights.
If Peter Childs trade supplier fails to deliver replacement goods in the
specified time to Peter Child then Peter Child will not be responsible for any
consequential loss incurred by the customer.
These conditions shall apply in accordance with English law.
All the above does not apply to business-to-business transactions, as they are
not covered by the Consumer Protection (Distance Selling) Regulations 2000.
TERMS AND Conditions OF TRADE (BUSINESS-TO-BUSINESS)
These terms and conditions will apply to all orders placed with Peter Child
save only as varied in writing by Peter Child.
Prices and manufacturers specifications subject to change without notice.
If prices quoted for the products of Peter Child in any brochure, magazine or
price list are correct and have not changed since were published, they are subject
to availability and exclusive of carriage.
Peter Child will only be bound once it has accepted an order by telephone or
in writing.
Peter Child will not be obliged to despatch any goods for which an order has
been accepted until it has received full payment by cleared funds.
Despatch or delivery dates quoted are approximate only and Peter Child shall
not be liable for any delay in despatch or delivery.
Any order cancelled before despatch of the goods may be subject to a deduction
by Peter Child from the price to be refunded or an administration fee.
Peter Child will accept goods returned within 10 days of delivery for which
Peter Child has issued a prior return authorisation number and provided the
goods are returned in the original packaging as dispatched and found to be undamaged
and in full working order. Peter Child will make a refund for the sale price
less a 25% restocking charge. The charge can be higher if the original packaging
has been damaged.
Peter Child will not accept any claims for damage to goods in transit during
delivery unless reported by telephone or facsimile within 48 hours of receipt.
Peter Child reserves the right to make an additional charge if the manufacturer
or trade supplier should make a charge on Peter Child for new packaging materials
due to the original packaging being damaged.
Peter Child will not accept any claims in respect of damage arising after delivery
or in the course of installation.

at its discretion refund a reasonable cost of carriage incurred for the return
of the goods.
